Maximizing HR’s Role in Supporting OFCCP & EEO Compliance Audits

The Office of Federal Contract Compliance Programs (OFCCP) released a technical assistance guide for educational institutions in late 2019 and there are indications that higher education will be audited more frequently in the next few years. While many institutions are responding to the new guidelines, some are unfamiliar with their institution’s Equal Employment Opportunity (EEO) obligations under OFCCP’s laws. Featuring a case study from a university that was recently audited, this session will provide practical tips and tools to maximize HR practices and initiatives around EEO compliance.

Gilberto Garcia, Jr. is a Senior Counsel with The Center for Workplace Compliance (CWC) headquartered in Washington, D.C., and is also a Senior Associate with the D.C. law firm of N.T. Lakis, LLP.

Mr. Garcia has 20 years of experience both in the public and private sectors specializing in labor and employment matters, particularly assisting firms with their EEO, OFCCP and HR compliance obligations.

Prior to joining CWC, Mr. Garcia served as the Director of EEO and Affirmative Action Compliance at George Washington University, working on EEO and affirmative action compliance matters in higher education. Previously, he spent 13 years with the U.S. Department of Labor, first as a Trial Attorney within the Solicitor’s Office in the Division of Civil Rights and Labor-Management and later as the Branch Chief for Enforcement and Appeals within OFCCP’s National Office

Mr. Garcia received his law degree from Syracuse University College of Law in Syracuse, New York and earned his B.A. in Government and Latin American Studies from the University of Texas in Austin, Texas.



Inderdeep Chatrath is a thought leader, advocate, and consultant engaged in enhancing diversity and equity in employment practices. Dr. Chatrath has served as the Assistant Vice President of Equal Opportunity & Affirmative Action Programs in the Office for Institutional Equity at Duke University and Health System for 20 years. In addition to her oversight of institutional research functions, the annual Affirmative Action Plan, and Equal Employment Opportunity policies, she has contributed to Duke’s programs for harassment prevention, diversity, and disability management.

Dr. Chatrath is currently serving her second term on the National Advisory Committee on Racial, Ethnic, and Other Populations of the U.S. Census Bureau and was recently selected to serve on the National Industry Liaison Group (NILG) Advisory Council.

Dr. Chatrath achieved her Doctorate in Adult and Higher Education Administration at The University of North Carolina at Chapel Hill.
